Dispute Management: More recently parties to a construction contract are becoming aware of the time involved and costs incurred in many construction disputes. Therefore it is becoming more frequent for contracting parties to include in their contract a form of Dispute Management which will allow the parties where a dispute occurs to refer the dispute to an independent third party, often named in the contract, to analyse the dispute. This is achieved through using some of the skills referred to above under dispute resolution e.g. adjudication, mediation. This allows the parties to continue with the project whilst the dispute is being resolved and avoids delays to the project and maintains good working relationships.
